Case Description
Mrs. Langlois sustained very serious injuries in a winter crash.
She suffered a below the knee amputation and serious injuries to
her other foot. At issue were the extent of her damages, and in
particular whether she was catastrophically impaired under current
insurance legislation. An animation was developed to demonstrate
the extent of her impairments. Despite opinions to the contrary
her case was settled on the basis of her being catastrophically
impaired.
We highly recommend our lawyers. Not only
are they extremely efficient and highly skilled in their professions,
but they are men of integrity and great respect. We appreciated
the fact that they gave our case undivided attention whenever we
met. We were always free to ask all our questions. They were always
available to us. Because of their specialty in personal injuries
and their efficiency, they provided us with access to highly skilled
medical professionals otherwise not available to us. Their team
work is very evident in the creation of a positive environment for
each case they accept. Thank you!

Case
Description
Kim McMaster suffered a so-called mild brain injury in a motor vehicle
collision. Because of continuing deficits she will never return
to work as an occupational therapist. Proof is always a challenge
in mild head injury cases, because the accident victim looks fine
and there is rarely any radiologic evidence of brain damage. Successful
presentation of such a case depends on thorough neuropsychological
and neuropsychiatric investigation and persuasive evidence from
lay witnesses who speak to the changes in function.
Roger Oatley has the unique ability and
knowledge to combine both the legal needs with the health care needs
of his client to ensure optimal legal representation. Mr. Oatley
was referred to me via my neurologist who held him and his legal
abilities in high esteem. Then as his client, I presented to him
with a diagnosis of "post-concussive syndrome" following
a motor vehicle accident. Prior to the accident, I was highly functioning,
employed in my profession as a nurse. I was also a mother of two
children and a homemaker in partnership with my husband. Following
the motor vehicle accident, I was struggling to care for my children,
my home, I lost my job as I was unable to function in my previous
role due to loss of cognitive functioning, chronic anxiety and depression.
None of these symptoms I had prior to the motor vehicle accident.
Mr. Oatley treated me with respect and sensitivity to my presenting
symptoms. He knew that "mild brain injuries were defined "mild"
in a medical sense in that they are not life threatening but that
a "mild brain injury" or "post-concussive syndrome"
as a direct result of an injury sustained from a motor vehicle accident
was significantly debilitating to a person, who, therefore, required
strong legal representation. I would strongly recommend his legal
services to others, if unfortunately, they were found in a similar
position.
Kim McMaster
1. We were very pleased with the legal
services provided by Roger Oatley and his staff. At our very first
meeting we were very impressed with Mr. Oatley's experience, professionalism
and understanding of our situation and how it impacted our lives.
We found Mr. Oatley to be extremely knowledgeable about the injuries
sustained in the accident and sensitive to the struggles we faced
in our lives moving forward. Throughout the legal process Mr. Oatley
was very focused on achieving the best possible result and we are
very satisfied that this was accomplished.
2. The lawyers and staff at Oatley, Vigmond were at all times very
professional, understanding and supportive. They willingly and patiently
explained the legal process to us, answered our questions and concerns
and helped keep us grounded. Mr. Oatley and his staff assembled
a very professional and compelling presentation for our mediation.
Clearly there was a lot of hard work and effort putting this together
and Mr. Oatley did an admirable job presenting this to the defense.
3. People with personal injuries need strong legal representation
to ensure that their current and future needs are properly addressed.
We would strongly recommend Oatley, Vigmond. to anyone that has
suffered a personal injury accident. Roger Oatley has the unique
ability and knowledge to combine both legal needs with the health
care needs of his clients to ensure optimal legal representation.

Description
In this case, a nine year old boy was struck by a truck while riding
his bicycle. Steven suffered from Attention Deficit Disorder before
suffering a brain injury in this collision. Because of the combined
effects of the ADD and the traumatic brain injury Steven requires
24 hour supervision and will never be able to work to earn a living.
It is a pleasure for me to recommend Roger
Oatley and his team. When my son was hit by a car my entire life
changed entirely. Because of my son's brain injury it has become
a full time occupation for me to care for him. I do not know how
I would manage without the regular monthly income we receive as
a result of the settlement of the lawsuit. I cannot recommend Mr.
Oatley and his caring team of professionals too highly. The details
of my sons accident and the complexities of his injuries made my
case very challenging. Because of the skill and persistence of Mr.
Oatley and his team my son has a future.

Description
In this case Paul Buckland was seriously injured, both physical
and emotionally when he was fishing with a young boy. A sea-doo
struck his fishing boat and killed the boy. The impact also shattered
Paul's knee. The major issue in this case was Paul's lifelong income
loss, since at the time of trial Paul was still able to work in
the same plant where he had worked for years. We developed a computer
animation to demonstrate the future deterioration of Paul's knee
and to explain to the jury why he would eventually become unemployable.
When I needed legal assistance after the
accident I turned to Oatley, Vigmond. During our first interview
Mr. Oatley set my mind at ease about concerns I had for the future
of my family and myself. Mr. Oatley and his team gained more of
my confidence and admiration during the months that followed. Always
polite and professional, they were thorough beyond my own imagination.
I know now that I was right in trusting the Oatley, Vigmond team
with the security and the future of my family and myself.
My sincerest of thanks go out to Mr. Oatley and the staff at Oatley,
Vigmond

Sandra Burton was attending a pool party when a group of young men
began to throw the young women into the pool. Sandra was thrown
in. She landed on her head and became a quadriplegic. Sandra's future
was at stake in the lawsuit we commenced against a number of the
young men who played a role in her tragic injury.
Right from the beginning of my lawsuit,
I was assured by many people that Roger was one of the best lawyers
in the field of personal injury litigation. I can honestly say that
Roger lived up to and even surpassed his extraordinary reputation.
Not only did he handle my case with a great level of skill, intelligence,
and dedication, he also treated my family and I with compassion
and sensitivity throughout the entire litigation process. Roger
and the rest of the firm who worked on my file made my family and
I feel confident and comfortable with the legal proceedings at all
times. Someone was always available to answer questions, provide
advice, and offer encouragement. Best of all, the successful result
achieved by Roger and the firm greatly increased my quality of life,
and enabled me to pursue my educational and personal goals. I am
grateful to Roger for all the hard-work and long-hours he dedicated
to my file, and would highly recommend him to anyone else who has
suffered a serious personal injury.

Ms. Carnegie Ward suffered soft tissue injuries and then developed
fibromyalgia following a car crash. Ms. Carnegie Ward transferred
her file to our firm from another firm as a result of poor legal
service.
After three unsuccessful attempts to engage
an interested lawyer to settle my accident claim, I was referred
to Oatley, Vigmond.
I was immediately made to feel my claim was important to them. They
took all my information down showing interest in my case, and compassion
for my feeling of helplessness. I had not been able to afford the
necessary treatments to help the conditions caused by my accident.
I was constantly in severe pain and becoming very discouraged.
Both the lawyer and the staff kept me informed, were very helpful,
always courteous and encouraging. They settled for me, to my satisfaction,
within 14 months. I highly recommend Oatley,Vigmond!

Darren Peddle's vehicle went out of control on black ice. We sued
the Ministry of Transportation because of its failure to salt the
roadway where he went out of control Liability was very much in
dispute, as was damages. We won a hard fought lawsuit at trial,
and the Ministry appealed to the Court of Appeal. We won there too.
Despite Darren's serious brain injury, his compensation has enabled
him to lead a life as a husband and father and member of his community.
I would like to commend Roger Oatley and
the staff at Oatley, Vigmond for their knowledge, dedication and
compassion, just a few of the components, which help make an outstanding
team. Roger Oatley helped me during an essential and demanding time

Description
Ms. Robitaille slept in the upstairs loft of a rental home. At noon
hour, she was awakened by the sound of flames and dense smoke. Both
the smoke detectors and a fire escape had been removed by the landlord.
In order to escape the fire she had to jump to safety from the perch
of her third floor window. As a result, Ms. Robitaille suffered
massive injuries to her lower extremities. Ms. Robitaille was referred
to Oatley, Vigmond by a psychologist….
Oatley, Vigmond was "the best thing"
that could have happened to me regarding my lawsuit. I felt intimidated
when the word "lawyer" came up. However, Oatley, Vigmond
treated me as a person, not just another money-making case. From
returning my calls, informing me at all times, and their compassion,
I no longer feel that intimidation. I felt supported and important.
I want to thank the team at Oatley, Vigmond, and recommend them
without a doubt!

Ms. Montrueil's son was born with very severe brain damage as a
result of medical malpractice. We brought an action against her
physician and the nurses at the hospital where her son was born.
Sometimes we are fortunate enough in life
to come across people with such heart, that their careers are not
just jobs, but rather, are reflections of their passion and sincerity
to help others. The outstanding dedication that Gayle Brock and
Roger Oatley put forth in our case has given us the strength to
get through one of the hardest and most painful times we’ll
likely ever face. When a doctor and hospital catastrophically injured
our baby boy at birth, two families who successfully settled suits
for wrongful death, referred us to this firm. While you may not
ever get back what you lost, I can attest that this firm will ensure
that you gain the compensation you deserve. A most heartfelt thank
you,

Joe Korzenko was always one to help others. On December 23rd, 2001,
Joe was assisting a motorist who had been involved in a single car
accident on Highway 400. He was steering traffic away from the stranded
motorist, when a limousine from Casino Rama struck and killed him.
Joe left behind his wife of 26 years, Christine and 2 children.
The family struggled to make ends meet as the family income was
reduce by half.
Over the past 3 and 1/2 years, I have
dealt with Jim Vigmond and a number of his staff and associates.
In every instance, I was treated with respect and never once made
to feel that I was a nuisance or demanding (even though I'm sure
there were times that I was!). While I appreciate that you chose
the field you are in, there are not many who conduct themselves
with the passion, determination and empathy that you display. I
can honestly say that there is not one single person in your firm
that I came in contact with who did not display the same caring
and professional attitude towards my family and I.

Ray Lahay suffered from chronic low back pain after being injured in a car crash in 1998. He was able to work for several years after the crash but ultimately succumbed to the pain. He quit his job 3 weeks before the start of trial. He rejected the defendant's offer to settle of $10,000. The judge agreed with Ray's lawyers that the injury was serious and awarded Ray $400,000 in damages.
The quality of legal representation was outstanding. Mr. Vigmond made sure I was ready to go into the Courtroom. His dedication and expertise prepared me to face what was ahead.

Description
Nicole Gilmour suffered permanent and serious impairments as a result of a car crash on August 3, 2003. Nicole suffered a brain injury, skull fractures, along with other injuries in the accident. Following the accident, Nicole was also diagnosed with myotonic dystrophy, which is an inherited disorder causing weakness and muscle wasting. One of the major difficulties in this action was establishing the extent of Nicole’s entitlement to damages as her ongoing impairments were seemingly caused both by her traumatic brain injury and by her hereditary myotonic dystrophy. An expert in the field that we retained came to the conclusion that Nicole’s head injury probably accelerated the onset of her myotonic dystrophy by 20-25 years. It was on this basis that the plaintiffs advanced their claim that all of Nicole’s ongoing symptoms and impairments were a consequence of her involvement in the car accident.
From the first meeting with Mr. Oatley at Sunnybrook Hospital I was treated with respect. We could feel the true concern for us and for our family. We were comforted when we had fears of new situations. Mr. Oatley and his team arranged doctor's appointments, Reconstructionist, liaison with the claims representative and case manager. All the hours on gathering information and research was so well orchestrated by a team that works so well together. This office is definitely a well oiled machine. Whenever we had a question we were able to obtain an answer with an email or phone call. At no time did anyone on the team make us feel as if we were inconveniencing them with our questions or our need for guidance.
The outcome of our settlement was well beyond our expectations.

Glen Rogers was seriously injured in a car accident on March 22, 2002, when the driver of an oncoming vehicle lost control and smashed into Glen head-on. Glen, who before the accident led a very full and active life, was left with a mild brain injury and a severe hip injury which eventually degenerated to the point where Glen had to undergo a total hip replacement. Due to his injuries, Glen is no longer able to enjoy the active life he had prior to the accident, and is unable to work. We negotiated a settlement for Glen which will enable him to live without the extra stresses placed on him without a full time employment income.
It was a tough five years for me and not once have I lost faith in you or Bill Teggart. I admire your tough stand in the negotiating segment of the case. I deeply respect the professionalism that you and your team have shown me and I can certainly see the pride and quality that each of you put into your work.

Case
Description
On February 21st, 2002, the life that I had known and enjoyed, essentially came to an
end. The last memory of my "walking" life was sitting down to dinner with my sister.
The first memory of my "disabled" life was waking up inside an MRI machine in a
hospital emergency room, answering a technician's questions. I was soon to learn that
I had suffered what is termed a catastrophic accident, having fallen down a steep set of
basement stairs and landing on a concrete floor. I had numerous injuries with the
worst being a spinal cord injury that left me with 75% of my body paralyzed.
Over the next few months, I discovered that there was a possibility that I was entitled to
an insurance settlement from my accident. The next step was finding a lawyer that
would work on my behalf in what turned out to be, unfortunately, an acrimonious
lawsuit. To my great fortune, I found the firm of Oatley, Vigmond and the eminently
skilled Mr. Jim Vigmond.
From my initial meeting with Mr. Vigmond, I felt my case couldn't be in better hands. My particular lawsuit was rather complicated and ultimately ended in a trial. During
every step of this difficult situation, I was impressed with the amount of effort put
forward by every single member of what I came to think of as "my Oatley, Vigmond
team".
The attention to detail regarding each aspect of my case was extraordinary. I was kept
completely apprised of all developments in the progression of my lawsuit and although
a trial outcome was not what I had desired, by the time of actual trial, I was confident
that absolutely everything that could possibly be done to prepare me for that outcome
had been completed. When I was testifying in court, I felt my whole team behind me.
Jim Vigmond is a remarkable and talented lawyer. He is a consummate professional
who truly cares about his clients. He and his staff were available to me for any and all
concerns I had during my case. Through my extensive dealings with his top-notch
staff, I came to appreciate what a cohesive and supportive group of individuals I had
working on my behalf.
The final trial settlement was a true victory for Mr. Vigmond and ensured me a life with
financial security. I am extremely grateful and couldn't have asked for anything more.
I would recommend the firm of Oatley, Vigmond with absolute conviction. They are an
exemplary group of legal professionals and an absolute pleasure to work with.
