Kelly Mitchell suffered a severe brain injury as a result of a dirt bike collision. Kelly, a father of 2 young children, was unable to return to work. He applied to his own insurance company and received accident benefits which paid for his medical and rehabilitation needs. Eventually, Kelly’s insurer negotiated a lump sum settlement of his accident benefits which allowed Kelly to fund his own medical and rehabilitation needs for the rest of his life.
Kelly also applied for long term disability benefits through his employer’s group insurance policy. However, Kelly discovered that because of an administrative error on his employer’s part, he was not covered for long term disability benefits under his employer’s insurance policy. The long term disability insurer eventually accepted Kelly’s application for benefits, but only after he started a lawsuit.

After a March 2001 snowmobile crash left me an incomplete paraplegic I thought I could handle the insurance company on my own. A year (and several adjusters) later, I realized I was getting run around by the insurer and sought legal counsel. Rick Winson was seriously injured when he was thrown from his snowmobile while crossing Lake Simcoe. He landed with his back on the ice and suffered a fractured lumbar spine and spinal cord injury as a result. Rick suffered from paraplegia and required the use of a wheelchair as a result of his spinal cord injury.
