    Nicole Gilmour was a 21 year old single mother who suffered a devastating brain injury when a vehicle in which she was a passenger smashed into a tree. The driver, who was intoxicated, was killed. An action was brought against the estate of the driver and against the tavern that served alcohol to the driver. There were challenges with damages as well as liability because before the crash Nicole suffered from a neurological condition, which the brain injury made worse. Also, Nicole and and her mother Maria cared for Nicole's son who was intellectually challenged.

    Pierrette sustained very serious injuries in a winter car crash. She suffered a below the knee amputation and serious injuries to her other foot.     Tracy Gow was injured in a motorcycle accident when the defendents' truck pulled out in front of Tracy's motorcycle and the vehicles came to a violent collision. Tracy sustained numerous fractures to her pelvis and lower back in the collision. She was required to undergo multiple surgeries because of the complexity of her injuries.     Joanne Robitaille slept in the upstairs loft of a rental home. At noon hour, she was awakened by the sound of flames and dense smoke. Both the smoke detectors and a fire escape had been removed by the landlord. In order to escape the fire, she had to jump to safety from the perch of her third floor window. As a result, Ms. Robitaille suffered massive injuries to her lower extremities. Ms. Robitaille was referred to Oatley, Vigmond by a psychologist.

    Tom was 53 years old when he was driving to work on February 4, 2004. The defendant crossed over the centre line and struck Tom’s vehicle head-on.     Lauren was a student at York University at the time of the crash. Like her mother, she dreamed of being a teacher. On January 28, 2005 Lauren was driving her vehicle on an evening out with her boyfriend. The defendant had stopped his tractor trailer in front of his driveway.     Kelly Mitchell suffered a severe brain injury as a result of a dirt bike collision. Kelly, a father of 2 young children, was unable to return to work. He applied to his own insurance company and received accident benefits which paid for his medical and rehabilitation needs. Eventually, Kelly’s insurer negotiated a lump sum settlement of his accident benefits which allowed Kelly to fund his own medical and rehabilitation needs for the rest of his life.

    Kelly also applied for long term disability benefits through his employer’s group insurance policy. However, Kelly discovered that because of an administrative error on his employer’s part, he was not covered for long term disability benefits under his employer’s insurance policy. The long term disability insurer eventually accepted Kelly’s application for benefits, but only after he started a lawsuit.

    After a March 2001 snowmobile crash left me an incomplete paraplegic I thought I could handle the insurance company on my own. A year (and several adjusters) later, I realized I was getting run around by the insurer and sought legal counsel. A recommendation by the Canadian Paraplegic Association lead me to the offices of Oatley Vigmond and specifically, Robert Durante.     Rick Winson was seriously injured when he was thrown from his snowmobile while crossing Lake Simcoe. He landed with his back on the ice and suffered a fractured lumbar spine and spinal cord injury as a result. Rick suffered from paraplegia and required the use of a wheelchair as a result of his spinal cord injury.

    Rick applied to his insurance company for accident benefits to pay for his lost wages, medical and rehabilitation services, as well as funds to pay for renovations to his house in order to make it wheelchair accessible. At first Rick thought he could handle things on his own because he was dealing with his own insurance company. However, Rick realized he needed to retain the help of a lawyer when his insurer had not yet paid to make his house wheelchair accessible, even though more than two years had passed since his injury.
