				<content:encoded><![CDATA[<p>As an Ontario resident, chances are that you have seen a deer or another large animal crossing on or near the highway on which you are travelling.  You may even be one of the 10,000 or more drivers who have been in an accident when one of these wild animals enters onto the roadway.  While most animal strikes on Ontario roads result in property damage only, some collisions result in serious injury to drivers and their passengers.</p>
<p>Obviously no one can sue a deer or a moose for causing the accident. However, a driver injured by a moose or deer can still access statutory accident benefits from his or her own auto insurance policy. Ontario’s Statutory Accident Benefits Schedule provides anyone who has been seriously injured in a motor vehicle collision with medical and rehabilitation benefits, attendant care benefits, income replacement benefits and non-earner benefits.</p>

<p>There is similar technology in modern motor vehicles.   Your car records data including speed, RPM and braking rates.   This data is recorded by a device that operates the air bags in the vehicle.   In many cases, it can be downloaded after a collision and used to determine how fast a vehicle was being driven or whether brakes were applied before a collision.</p>
<p>As with airplane crashes, this electronic data is often crucial in determining what went wrong and who is at fault for a motor vehicle collision   It is important that this data be retrieved quickly following a collision because it will disappear with time.</p>
<p>This is one of the reasons why it is important to promptly retain an experienced personal injury lawyer if you or a family member is seriously injured in a motor vehicle collision.   Experienced personal injury lawyers will hire engineers to obtain and preserve the electronic data contained within the vehicles involved in the collision.  Very often, this data is the most important piece of evidence in a case.</p>

				<content:encoded><![CDATA[<p>The British Journal of Sports Medicine recently published the results of a study finding no good evidence that helmets prevent concussion.  Ironically, the consensus statement from the 28 neurologists who examined the research concluded that helmets may even encourage users to assume greater risks.</p>
<p>While helmets may not prevent concussion, they are an effective piece of safety equipment when participating in sports that take place on hard surfaces.  Helmets can prevent skull fractures and other serious forms of head injury when worn in sports such as skiing, snowboarding, cycling, motor, off-road and equestrian sports.  Their effectiveness is lessened when the helmet has been improperly fitted, worn too loosely, kept for too long, or even worn after already being exposed to a heavy blow.</p>
<p>Parents need to use caution when considering the type and design of helmets chosen for children.  A helmet is not something that a child should be expected to grow into.  Additionally, helmet covers that add Mohawks, devil horns, or animal ears and tails can change the design characteristics in ways that lessen the helmet’s effectiveness.  Studies have also shown that helmets that do not slide smoothly against a surface can expose users to injuries by increasing forces against the head and neck.  The inability for a helmet to slide smoothly can also create enough friction between surfaces to pull open a helmets chinstrap exposing the head to greater injury.</p>
<p>Helmets are effective at lessening the blow from an impact with a hard surface when they are used and worn as the manufacturer intended.  Unfortunately, head injuries will still occur across all sports and hobbies, whether or not they are played at an elite level.  If you, or someone you know, has suffered a head injury because of a sporting or other accident it is important to speak to an experienced personal injury lawyer who can advise you on your legal rights.</p>

				<content:encoded><![CDATA[<p align="LEFT">Accidental death and dismemberment (AD&amp;D) insurance is a form of life and disability insurance. AD&amp;D insurance is designed to provide your family with a lump sum of money in the event of your accidental death. AD&amp;D insurance is also designed to provide you with lump sum compensation if life changing events occur such as an accident causing paraplegia or quadriplegia, loss of use of a hand or foot or loss of speech, hearing or vision.</p>
<p align="LEFT">The advantage of AD&amp;D insurance is that it is generally less expensive than life insurance. The disadvantages of AD&amp;D insurance are that it is not an investment like a whole life insurance policy and that there are often numerous exclusions contained in the policy. These exclusions often include no requirement to pay if a death occurs due to suicide, alcohol or drug abuse, illness, war, radiation or natural causes. Given the exclusions, insurance companies often delay paying out on AD&amp;D death claims until an autopsy and investigation of the death has occurred.</p>
