Kusnierz v. Economical Mutual Insurance Company

On December 23rd, the Ontario Court of Appeal delivered its Judgment in Kusnierz v Economical. In a unanimous judgment, the Court reversed the trial judge and held that the SABS permit combining physical and psychological impairments in assessing 55% Whole Person Impairment under para 2(f) of the SABS. The decision will affect thousands of people who have suffered physical and psychological injuries in car crashes. James Vigmond, Brian Cameron, Adam Little and Troy Lehman worked as a Committee to represent the Ontario Trial Lawyers Association who was an Intervenor in the appeal.
