$24 Million Verdict - Young Man Suffers Severe Brain Injury Because of Negligence of Drunk Driver
Young man suffers severe brain injury because of negligence of drunk driver: Our client was a fine young man who was a passenger in a vehicle with several other youths. All of the young men became intoxicated. The driver lost control and crashed into a tree. The Oatley team acted for the young man with a brain injury. The Vigmond team acted for a young man who became a paraplegic. The defence in the case was the failure to wear seat belts and the knowledge of the two young men of the intoxication of the driver. Our brain injured client needed 24 hour care because of his impulsivity and poor judgement, which jeopardized his safety. One of the challenges we faced was convincing the court that a man who looked and sounded fine was so severely impaired. He would never work because of his impairments. After a lengthy contested trial the court awarded damages to the two young men totalling over $24,000,000 – the largest joint damages award in Canadian history. These funds will secure the quality of life of these two young men.
